Emily Jenkins Studio: self-paced online courses for actors

Key points
Read these first. The full terms follow and take precedence.
- The subscription gives you online access to my self-paced course library for as long as you keep paying.
- It costs the monthly price shown at checkout (£40 a month at the date of these terms, including any VAT that applies), charged when you subscribe and then automatically on the same date every month until you cancel.
- There is no minimum term and no cancellation fee. The minimum you will ever pay is one month. You can cancel at any time from the Billing page of your account or by emailing me. Cancellation takes effect at the end of the month you have paid for, and you keep access until then.
- I email you a reminder at least 7 days before every monthly payment.
- You get access immediately when you subscribe. Because of that, you are asked at checkout to confirm that you want access straight away and that this ends your usual 14 day right to cancel the digital content. Clause 7 explains it.
- Payments are not refunded once access has begun, except in the situations listed in clause 8 and where the law requires it.
1. Who I am
1.1 The subscription is provided by Emily Jenkins, trading as Emily Jenkins Studio.

1.4 "I", "me" and "my" mean Emily Jenkins, trading as Emily Jenkins Studio. "You" and "your" mean the person who buys or uses the subscription.
2. These terms and who can subscribe
2.1 These terms apply to the monthly subscription to my self-paced online courses and related digital content. By subscribing you agree to them. Please save a copy for your records.
2.2 Live cohorts, the Drop-in Clinic and one-to-one coaching are separate purchases with their own terms and are not included in the subscription.
2.3 These terms are written for individuals subscribing for their own education and professional development. If you want to buy for a business or organisation, contact me first.
2.4 You must be at least 18 to subscribe. If you are 16 or 17, a parent or guardian must buy the subscription in their own name, agree to these terms and take responsibility for your use of the course.
2.5 My privacy notice explains how I use your personal information.
3. What the subscription includes
3.1 While your subscription is active you can access, through my online course platform, the self-paced courses, lessons, videos and other digital materials that are included in the subscription at the time. Everything is delivered online. Videos are streamed and are not available offline. You need an internet connection and a device with an up-to-date web browser.
3.2 The library will develop over time. I may add, update, replace or remove individual lessons and materials where I reasonably need to, provided this does not materially reduce the overall service you are paying for. Clause 16 explains what happens if I make a bigger change.
3.3 Some lessons include files you can download. Clause 12 explains what you may do with them.
4. Price, monthly billing and automatic renewal
4.1 This is a recurring monthly subscription. The price is shown at checkout in pounds sterling and includes any VAT that applies. At the date of these terms the price is £40 a month.
4.2 You pay for the first month when you subscribe. Your subscription then renews automatically every month on the same date as your original purchase (or on the last day of the month if that date does not exist), and the payment method you gave me is charged the monthly price each time.
4.3 You do not need to do anything for the subscription to renew. It continues, and you continue to be charged, until you cancel it or I end it under these terms.
4.4 Before you complete your purchase I show you the price, that the payment is monthly and recurring, when I send reminders, and how to cancel. At the final checkout step you must tick a box confirming that you understand the recurring payment.
4.5 There is no minimum term and no cancellation fee. The minimum total you will pay is one month's subscription. You are never liable for a monthly payment before the month it pays for begins.
5. Payment reminders and service emails
5.1 I will email you a reminder at least 7 days before each monthly payment is taken. The reminder states the date of the payment, the amount, and how to cancel before it is taken.
5.2 Reminders, receipts, cancellation confirmations and notices about your subscription are service emails, not marketing. I send them to the email address on your account for as long as you are a subscriber, whatever your marketing preferences. Please keep that email address up to date.
6. Cancelling your subscription
6.1 You can cancel at any time. Cancelling stops your subscription from renewing. It does not end the month you have already paid for.
6.2 To cancel online: log in to the course platform, click your avatar, choose Settings, then Billing, then Cancel subscription next to your subscription, and confirm. I will email you to confirm the cancellation and the date your access ends.
6.3 You can also cancel by emailing hello@emilyjenkins.studio with the name and email address on your account and a clear statement that you want to cancel. Your cancellation counts from the day I receive your email, even if I take longer to confirm it. I aim to confirm within 2 working days. If a payment is taken after I have received your cancellation email, I will refund it.
6.4 To avoid being charged for another month, cancel before your next renewal date. Your reminder email tells you when that is.
6.5 After you cancel, you keep access until the end of the month you have paid for. Your access then ends and you will not be charged again unless you subscribe again.
6.6 Cancelling the payment with your bank or card provider is not the same as cancelling with me. Please use clause 6.2 or 6.3 so that I can confirm your cancellation and close your subscription properly.
7. Immediate access and your 14 day right to cancel
7.1 When you buy digital content online you normally have 14 days in which you can change your mind and cancel.
7.2 The subscription gives you access to the course content immediately after you pay. At checkout you are asked to tick a box in which you agree to these terms, confirm that you understand the payment is recurring, ask me to give you access straight away, and acknowledge that once access begins you lose your 14 day right to cancel in respect of the digital content.
7.3 I confirm your request and acknowledgement in the receipt I email you after you subscribe.
7.4 Nothing in this clause removes any cancellation right that the law does not allow me to exclude. If you keep a right to cancel and want to use it, you can use the form at the end of these terms or simply email me in your own words.
8. Refunds
8.1 Except as set out in this clause or where the law requires, subscription payments are not refunded once access to the digital content has begun.
8.2 In particular, I do not refund a month's payment because you did not use the course during that month, changed your mind after getting access, did not finish a course before cancelling, or forgot to cancel before the renewal date, provided I sent you the reminder described in clause 5.
8.3 I will refund you where:
(a) the digital content is faulty, not as described or otherwise does not meet the standards required by consumer law, and the problem cannot be put right;
(b) I end your subscription or close the service for a reason other than your breach of these terms, in which case I refund the unused part of the month you have paid for;
(c) I have made an error in charging you, in which case I refund the overcharge; or
(d) the law entitles you to a refund, for example if I failed to give you information or a reminder that the law required.
8.4 Refunds are made to the payment method you used, normally within 14 days of my agreeing the refund.
8.5 This clause does not affect your statutory rights (see clause 21).
9. Free trials and introductory prices
9.1 I do not currently offer free trials or introductory prices. If I introduce one, I will tell you before you subscribe when it ends and what you will pay afterwards, and I will remind you before the first full price payment.
9.2 If you subscribe on a free trial or introductory price, you will have a further 14 day right to cancel starting from the first full price payment. If you cancel in that period I will refund the part of that payment that relates to the days remaining in the month.
10. Price changes
10.1 I may change the monthly price. If a change affects an existing subscriber, I will email you at least 30 days before the new price applies.
10.2 A price change never applies to a month you have already paid for. If you do not want to pay the new price, cancel before it takes effect and you will not be charged it.
11. Payment
11.1 Payments are taken through the course platform's payment provider (currently Stripe). I do not store your card details myself.
11.2 By subscribing you authorise me and my payment provider to charge your chosen payment method each month until you cancel.
11.3 Keep your payment details up to date. You can update them on the Billing page of your account.
11.4 If a payment fails, I or my payment provider may retry it. Your access is suspended automatically when a payment fails and restored automatically when the payment succeeds; your renewal date does not change. If the payment is still outstanding 14 days after the renewal date, I may end your subscription.
12. Your account and how you may use the content
12.1 Your subscription and account are personal to you. Keep your login details secure and tell me if you think someone else is using your account.
12.2 You must not:
(a) share your login details or let anyone else use your account;
(b) copy, record, screen capture, download or distribute course materials, except files I provide as downloadable;
(c) upload or feed course materials into any other website, platform, file-sharing service or artificial intelligence system;
(d) sell, license, sublicense or otherwise commercially exploit course materials;
(e) use course materials to create or deliver a competing course, training service or product; or
(f) use the platform unlawfully or in a way that harms me or other users.
12.3 Where I provide a file as downloadable, you may keep a copy for your own personal use. The restrictions in clause 12.2 still apply to it, and to any notes or recordings you make.
12.4 I may suspend or end your access under clause 15 if I reasonably believe your account is being shared or misused.
13. Intellectual property
13.1 All course videos, recordings, written materials, exercises, worksheets, graphics, teaching methods and other original content belong to me or the relevant rights holder. Subscribing does not transfer any of these rights to you.
13.2 While your subscription is active, you have a personal, limited, non-exclusive, non-transferable licence to access and use the materials for your own education and professional development. The licence ends when your access ends, except for downloadable files kept under clause 12.3.
14. What the course is, and what I do not promise
14.1 The course is provided for education and professional development. Acting, performance and careers depend on many factors outside my control.
14.2 I do not guarantee employment, representation, auditions, casting, professional advancement, financial results or any particular performance outcome.
14.3 Nothing in this clause limits my obligation to supply the course as described and with reasonable care and skill.
15. Suspending or ending your subscription
15.1 I may suspend or end your subscription if you seriously or repeatedly breach these terms, share your account, infringe my intellectual property, attempt to reproduce or distribute course content without permission, use the platform unlawfully, or fail to pay.
15.2 Unless the breach is serious or cannot be put right, I will tell you what is wrong and give you a reasonable chance to fix it before ending your access.
15.3 I may also close the subscription service altogether. If I do, I will give you at least 30 days' notice by email and refund the unused part of any month you have paid for.
15.4 Nothing in this clause affects any refund or other right you have under the law.
16. Availability and changes to the service
16.1 I aim to keep the course platform available at all times but cannot guarantee uninterrupted access. Short interruptions may happen because of maintenance, technical faults, internet outages or problems with third party services.
16.2 If a substantial interruption that I am responsible for materially prevents you from using the service you have paid for, I will extend your access, give you a proportionate refund, or provide another appropriate remedy.
16.3 I may make reasonable changes to the course, for example updating lessons, replacing recordings or restructuring modules. I will not make a change that materially disadvantages existing subscribers unless I have a reasonable justification, and I will give you at least 30 days' notice by email of any such change so that you can cancel before it takes effect.
17. Changes to these terms
17.1 I may update these terms where reasonably necessary, for example because of changes to the service, my platform or the law. Changes do not remove rights you have already acquired.
17.2 If a change materially affects your subscription, I will email you at least 30 days before it takes effect. If you do not agree to it, cancel before it takes effect and it will not apply to you.
17.3 The current version of these terms is always available at learn.emilyjenkins.studio/terms and shows the date it was last updated.
18. Third party services
18.1 The subscription is delivered using Kajabi and payments are processed by Stripe. Your use of the platform may also be subject to their terms and privacy policies.
18.2 I am not responsible for failures caused solely by third party services outside my reasonable control, but this does not limit any responsibility the law does not allow me to exclude, and I remain responsible for supplying the subscription to you.
19. Personal information
19.1 I process your personal information as described in my privacy notice. My platform and payment providers process your information on my behalf in order to run the service.
20. My liability to you
20.1 Nothing in these terms excludes or limits my liability where it would be unlawful to do so, including for death or personal injury caused by my negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot legally be excluded.
20.2 I am responsible for loss or damage you suffer that is a foreseeable result of my breaking these terms or failing to use reasonable care and skill. I am not responsible for loss that was not foreseeable when you subscribed, or for business losses if you subscribed for personal purposes.
20.3 If digital content I supply damages a device or other digital content belonging to you, and this is caused by my failure to use reasonable care and skill, I will repair the damage or pay you compensation, as the law requires.
21. Your statutory rights
21.1 Nothing in these terms restricts your rights as a consumer. Digital content supplied to consumers must be of satisfactory quality, fit for purpose and as described, and you have remedies if it is not.
21.2 Where the law gives you rights or remedies that cannot be excluded by contract, those rights apply regardless of anything in these terms.
22. Events outside my control
22.1 I am not responsible for delays or failures caused by events outside my reasonable control. If such an event materially affects the service for a significant period, I will take reasonable steps to reduce the effect and will provide any remedy the law requires, including under clause 16.2.
23. Complaints and disputes
23.1 If something goes wrong, email me at hello@emilyjenkins.studio and I will try to put it right. I aim to acknowledge complaints within 2 working days and to respond fully within 14 days.
23.2 I am not required to use, and do not currently use, an alternative dispute resolution provider. If I cannot resolve your complaint, I will tell you so in writing. You can still bring a claim in court under clause 24.
23.3 Consumers in the United Kingdom can get free, independent advice from the Citizens Advice consumer service.
24. Governing law and where you can bring a claim
24.1 These terms are governed by the law of England and Wales, and you can bring a claim in the courts of England and Wales.
24.2 If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts, and you keep any mandatory consumer protections that apply where you live.
24.3 If you live outside the United Kingdom, you keep any mandatory consumer protections of the country where you live and any right you have to bring a claim in your local courts.
25. Other terms
25.1 Each clause of these terms operates separately. If a court or authority decides that any part is unlawful, the rest continues in force.
25.2 If I delay in enforcing these terms, I can still enforce them later.
25.3 I may transfer my rights and obligations under these terms to another organisation that takes over my business. I will tell you if this happens and it will not reduce your rights. You may not transfer your subscription to anyone else.
25.4 These terms are between you and me. No one else has any rights under them.
